- Ernest signed up for Short Service (7 years) and joined the 1st Battalion, Sherwood Foresters (aka Notts and Derbyshire Regiment).
Ernest's early years in the military were clearly "difficult".
- 27 October 1908: Brought before the courts in respect of an order of maintenance for a bastard child.
- 11 December 1908: Deserted from Fermoy, County Cork, Ireland. Eventually arrested by Police Officer Dempster Galey on 4 January 1909 in Norton, Sheffield. The policeman was awarded a ten shilling reward and Ernest was brought before the magistrates on 5 January 1909. 28 days detention
- 13 April 1909: Deserted from Fermoy, County Cork, Ireland. Arrested by Sergeant Thomas Westman on 14 April 1909 at the Quay, Waterford, Ireland. The Sergeant was awarded a twenty shilling reward. 112 days detention for desertion, stoppage of pay to cover cost of rifle and other military possessions and all former service towards engagement forfeited.
- 11 August 1913: Charged with being in bed 2 hours after reveille. Severely reprimanded by Major Mortimer
Ernest must have made good after these incidents because a report by his commanding officer dated 4 May 1914 states that he was ... "Steady, honest and hard working".
Ernest was formally discharged on 31 December 1915 although by then, he was already a Police Officer in the Bombay Police Force and resident, with his wife, at the police station in Princess Street, Bombay. Prior to his discharge, Ernest served as the Regimental Librarian for 18 months. He had held the rank of Lance Corporal from 1 May 1911.

- Annie Moore of 294, Derbyshire Lane, Sheffield, made an application for a summons to be served on Ernest relating to the birth of a bastard child, of which, he was the father. At the time, Ernest was a Private, serving in "G" Company, Notts and Derbyshire Regiment, in Fermoy, Ireland. Under the Poor Law Amendment Act, 1844, Ernest was ordered to pay the sum of two shillings and sixpence per week in maintenance of the child until the child reaches the age of 14 or dies (if before). Ernest was further ordered to pay 10 shillings and sixpence, being the expenses incidental to the birth of the child and and a further sum of forty-five shillings and sixpence, in court costs.
